1. General

  1. 1.1 These Terms of Use apply to using the Playalong.studio website and its content.
  2. 1.2 By visiting our website, you accept these Terms of Use and our Cookie and Privacy Policies.
  3. 1.3 If you do not agree, do not visit the website or use our services.
  4. 1.4 Playalong.studio is operated by JamSync Audio GmbH, Wolfsangerstr. 133, 34125 Kassel, Germany (Commercial Register Number HR 00000 Amtsgericht Kassel).
  5. 1.5 By registering, you confirm that you have read and accepted these Terms of Use.
  6. 1.6 JamSync Audio GmbH reserves the right to change the Terms of Use anytime. Changes take effect upon publication on www.playalong.studio.

2. Services and Usage Restrictions

  1. 2.1 Playalong.studio offers musical content (playalong songs) via a web player for private musical education.
  2. 2.2 Any public or commercial use of the content is prohibited.
  3. 2.3 The content is the property of JamSync Audio GmbH and may not be duplicated or distributed.
  4. 2.4 Legal action will be taken for copyright infringements.
  5. 2.5 Use of the content requires registration and an account. Registration is only permitted for legally competent individuals.
  6. 2.6 Playalong.studio may change its content offering at any time.

3. Trial Period, Subscriptions, Payments, Termination

  1. 3.1 After opening an account, you must select a subscription and provide a payment method.
  2. 3.2 The first 14 days are free. The subscription can be cancelled at any time.
  3. 3.3 After the trial period, payment is automatic. Cancellations are possible at the end of the subscription period.
  4. 3.4 Changes to the subscription will take effect at the end of the current period.
  5. 3.5 You agree to pay for all products purchased. Payments are processed through third-party systems.
  6. 3.6 JamSync Audio GmbH does not collect payment information.
  7. 3.7 Price changes will be announced in advance and will take effect as soon as possible in the next subscription period.
  8. 3.8 If you disagree with a price change, you can cancel your subscription before the new prices take effect. Cancellation must occur before the start of the latest subscription period, during which the price change becomes effective.

4. Copyrights

  1. 4.1 All content on the website, including texts, graphics, images, designs, videos, information, and music, is the property of JamSync Audio GmbH or its licensors and must not infringe on the rights of third parties.
  2. 4.2 You may not transfer, display, or perform the content, except as provided in these Terms of Use.
  3. 4.3 No further rights to the content are transferred to you, except the usage rights expressly granted in your subscription and these Terms of Use.
  4. 4.4 You must comply with all applicable laws and regulations. Use of the content without prior written consent from JamSync Audio GmbH is not permitted.
  5. 4.5 Use of the content without written consent from JamSync Audio GmbH is prohibited.

5. Advertising, Data Protection, and Personal Data

  1. 5.1 By agreeing, you will receive commercial communications, newsletters, and advertising from JamSync Audio GmbH.
  2. 5.2 You can unsubscribe at any time.
  3. 5.3 JamSync Audio GmbH processes personal data in accordance with the applicable Data Protection and Cookie Policies.

6. Duration and Termination

  1. 6.1 Your subscription remains in effect until it is canceled by you or JamSync Audio GmbH.
  2. 6.2 Upon termination or violation of these Terms of Use, your right to use the service ends immediately.
  3. 6.3 JamSync Audio GmbH may suspend or delete your account and access.
  4. 6.4 You can permanently delete your account, losing all purchased content.

7. Disclaimer

  1. 7.1 JamSync Audio GmbH strives to offer the Playalong.studio service without interruption. However, technical problems, maintenance work, or unforeseen events may lead to temporary interruptions. Planned maintenance is conducted, where possible, outside of peak usage times to minimize disruptions for users.
  2. 7.2 JamSync Audio GmbH is not liable for unavailability due to insufficient internet bandwidth or other events beyond its control.
  3. 7.3 JamSync Audio GmbH may change or discontinue platform features at any time.
  4. 7.4 Your sole and exclusive remedy for any issues or dissatisfaction with the service is to stop using the service, as permitted by applicable law.

8. Indemnification

  1. 8.1 You agree to indemnify and hold JamSync Audio GmbH (including affiliates) harmless from any claims, liabilities, and costs arising from your misuse of the service not in strict accordance with these Terms of Use.
  2. 8.2 JamSync Audio GmbH reserves the right to assume the exclusive defense and control of any matter for which you are required to indemnify them, at their own expense. In such cases, you agree to cooperate fully with JamSync Audio GmbH in asserting any available defenses.

9. Assignment

  2. 9.2 You may not transfer these Terms of Use to third parties.

10. Severability

  1. 10.1 Should any provision of these Terms of Use be invalid or unenforceable, the remaining provisions will remain valid and enforceable.

11. Jurisdiction

  1. 11.1 The place of jurisdiction is Germany, with the Amtsgericht Kassel having initial jurisdiction.
  2. 11.2 All disputes are subject to German law.
  3. 11.3 JamSync Audio GmbH reserves the right to seek damages or injunctive relief for unauthorized duplication or public distribution before any competent court.
